2. The Kentucky Derby Museum Logo.

A. Non-commercial use. The Kentucky Derby Museum hereby licenses The Kentucky Derby Museum Logo for non-commercial products and non-commercial web sites. Acceptable non-commercial use of The Kentucky Derby Logo includes:

• As a logo to identify Kentucky Derby Museum-related web pages, e.g. if licensee is a Kentucky Derby Museum member.
• As a logo to identify Kentucky Derby Museum-related content in presentations given at conferences.
• The following use of The Kentucky Derby Museum Logo is not acceptable, and no license is granted for such use:
• Use is unrelated to The Kentucky Derby Museum or to the Brown Foundation.
• The logo is used in a detrimental way for The Kentucky Derby Museum. The Kentucky Derby Museum reserves the right to revoke this license at any time.

B. Commercial use. The Kentucky Derby Museum is under certain circumstances willing to license The Kentucky Derby Museum Logo for certain commercial products, services, and web pages. To inquire about the commercial use of The Kentucky Derby Museum Logo, please send email to <info@derbymuseum.org> with a description of the product, service, or web site, indicating where and how you'd like to use The Kentucky Derby Museum Logo.

3. The Kentucky Derby Museum Images.

A. Non-commercial use. The Kentucky Derby Museum hereby licenses The Kentucky Derby Museum Images for non-commercial products and non-commercial web sites provided that both MOVT and The Kentucky Derby Museum are given full credit for the images. Acceptable non-commercial use of The Kentucky Derby Images includes:

• As an image used in an article pertaining to the Kentucky Derby and/or the Kentucky Derby Museum.
• As an image used in an educational or research publication or report pertaining to the Kentucky Derby and/or the Kentucky Derby Museum.
  

The following use of The Kentucky Derby Museum Images is not acceptable, and no license is granted for such use:

• Use is unrelated to The Kentucky Derby, The Kentucky Derby Museum or to the Brown Foundation.
• The logo is used in a detrimental way for The Kentucky Derby Museum.
• Proper credit is not given to both MOVT and The Kentucky Derby Museum.

4. Additional Legal Terms and Conditions. Any reprinting, sublicensing, modifying, publishing, assignment, transfer, sales, or other distribution of the Kentucky Derby Museum Logo or Kentucky Derby Museum Images, in part or as a whole, is strictly prohibited without the prior written consent of the Kentucky Derby Museum. The Kentucky Derby Museum Logo and Kentucky Derby Museum Images are to be used "as it appears" and must not be cut up or materially altered without prior written permission of the Kentucky Derby Museum. Any copyright notice, digital watermark or proprietary legend contained in or on the logo must not be altered or removed. Unauthorized copying of the Kentucky Derby Museum Logo and/or Kentucky Derby Museum Images or failure to comply with any of the terms, restrictions, conditions, or limitations herein will result in automatic termination of this non-exclusive license. These terms of this agreement are subject to change without notice.
